Bombay High Court Dismisses Caveat Over Inherited Property

MUMBAI: The Bombay High Court dismissed a caveat filed by Khushroo Behramshaw Mogal, a 51-year-old Parsi man. He claimed to have inherited a share in the Kemp’s Corner bungalow of a deceased Parsi heiress using an allegedly forged will.

The court ordered an inquiry into whether details of a testamentary petition pending in court had been leaked. This leak may have helped Mogal forge a will to claim part of the property.

This decision follows a previous order from four months ago. The court directed the prothonotary and senior master to file a complaint against Mogal for criminal offences under the Bharatiya Nyay Sanhita and sections of the Indian Penal Code for falsifying evidence and forgery.

Mogal claimed to be “just like a son” to Hilla Dadysett, the last member of a prominent Parsi family. Dadysett passed away on May 22, 2023.

While a testamentary petition seeking probate of her will was pending in the Bombay High Court, Mogal filed a caveat claiming a share in Dadysett’s bungalow. The executors of the will, Hoshang and Rashna Khan, filed an interim application that the court allowed.

Justice Milind Jadhav expressed the need for a probe into how Mogal accessed Dadysett’s will. He stated, “This is a fit case for enquiry as to how the Caveator (Mogal) got hold of the papers of the Testamentary Petition.”

The judge ordered an internal inquiry to ensure that testamentary proceedings filed in court do not leak or fall into the wrong hands.

Dadysett left behind a will that bequeathed her share in her home, Monte Rosa, a 3,599.54-sq m bungalow at Kemp’s Corner, valued at approximately ₹250 crore, to charity. Mogal produced a will dated March 22, 2023, claiming it was Dadysett’s latest will.

In his order, Justice Jadhav noted, “It is clearly discernible that the alleged will propounded by the caveator (Mogal) did not exist at the time of the deceased.” He suggested that Mogal may have fabricated the alleged will using information from the testamentary petition.

HT reported on September 21, 2025, that there were four codicils to Dadysett’s will of December 18, 2015. The last one was dated February 27, 2023. Mogal filed a caveat based on a purported will of March 23, 2023, which he insisted was valid.
